SAN FRANCISCO – Two restaurant workers allege their San Francisco employer failed to pay minimum wages during their employment.
Antonio Guerriero and Miguel Silva filed a complaint on April 5 in the San Francisco County Superior Court against Francesco D'ippolito; Verrotta LLC, doing business as Cesco Pizza and Poesia; and Does 1 through 10 alleging failure to pay a minimum wage, failure to pay overtime and other counts.
According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week but were not paid minimum or overtime wages. The plaintiffs holds D'ippolito, Verrotta LLC and Does 1 through 10 responsible because the defendants also allegedly failed to provide adequate rest and meal periods to the plaintiffs, failed to provide accurate wage statements and other allegations..
The plaintiffs request a trial by jury and seek compensatory and consequential damages, unpaid wages, liquidated damages, punitive damages, treble damages, statutory damages, interest, all legal fees and any other relief as the court deems just.
