Zurich American Insurance alleges Liberty Surplus Insurance breached contract

SAN FRANCISCO – An insurance firm alleges that another firm breached its duty to defendant and indemnity businesses in legal matters.

Zurich American Insurance Co. filed a complaint on April 5 in the San Francisco County Superior Court against Liberty Surplus Insurance Corp. and Does 1-20 seeking declaratory relief.

According to the complaint, A&B Painting, Boberg Engineering and Contracting, Crux Subsurface and Frazier Masonry Corp. were issued commercial general liability insurance policies by the plaintiff. The suit states the defendant received tenders from those companies regarding some lawsuits, but that the defendant denied the tenders. The suit states the plaintiff was also issued tenders and it provided defense in the suits.

The plaintiff seeks declaration that the defendant has an obligation to defend the insureds, monetary damages, all legal fees and any other relief as the court deems just. It is represented by William C. Reeves and W. Brian Jones of Morales Fierro & Reeves in Pleasant Hill.
