Johanson Transportation Service seeks more than $34,000 for cargo

FRESNO – A Fresno third-party solutions provider and license property broker claims a motor carrier broke a seal on a cargo of spices in violation of their contract.

Johanson Transportation Service filed a complaint on April 18 in the Fresno County Superior Court against Dallas Logistics Inc. alleging breach of contract.

According to the complaint, the plaintiff and defendant executed a contract in 2016 for the defendant to take a shipment of spices from Firebaugh to Maryland. The plaintiff holds Dallas Logistics Inc. responsible because the defendant's driver allegedly broke the seal on the shipment prior to delivery, causing the load to be rejected. The plaintiff alleges it had to pay $34,849.32 for the shipment and submitted the claim to the defendant, but the defendant has yet to make any restitution.

The plaintiff requests a trial by jury and seeks damages in the amount that exceeds $34,849.32, interest, all legal fees and any other relief as the court deems just. It is represented by Nikole E. Cunningham of McCormick, Barstow, Sheppard, Wayte & Carruth LLP in Fresno.
