Parents claim birth injuries led to child's cerebral palsy

SAN FRANCISCO — Two parents are suing California Pacific Medical Center, Dr. Jason M. Dimsdale, Dr. Sarah S. Hebl and Golden Gate Obstetrics and Gynecology, citing alleged negligent infliction of emotional distress.

B. Mehta-Khan, a minor, by and through his guardian Prapti Mehta and Himayat Khan, filed a complaint on April 6 in the San Francisco County Superior Court against the defendants alleging that they failed to provide adequate and complete care, attention and other medical services.

According to the complaint, the plaintiffs allege that minor plaintiff suffered fetal asphyxia at birth in January 2016, which resulted in hypoxic ischemic encephalopathy and cerebral palsy. Plaintiffs incurred necessary medical expenses for the proper care of minor plaintiff. The plaintiffs hold the defendants responsible because they allegedly negligently failed to manage and timely deliver the minor plaintiff.

The plaintiffs request a trial by jury and seek general and special damages, plus interest, costs and such other just and proper relief. They are represented by Bradley M. Corsiglia of Corsiglia McMahon & Allard LLP in San Jose.
