FRESNO — A consumer is suing First Data Merchant Services LLC, a collection agency, citing failure to investigate the plaintiff's dispute into an alleged debt.
Daniel Baghdanov filed a complaint on April 20 in the Fresno County Superior Court alleging that the defendant failed to comply with provisions of the Fair Credit Reporting Act.
According to the complaint, the plaintiff alleges that he suffered extreme mental anguish, a damaged reputation and loss of ability to establish credit. As a result, plaintiff was unable to purchase and finance an automobile. The plaintiff holds First Data Merchant Services responsible because it allegedly reported a collection account that should not have been reported and failed to investigate the plaintiff's dispute into the report.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus costs and fees.
