Man alleges Chevrolet vehicle he purchased has defects, seeks rescission of sales contract

FRESNO – A Fresno County man alleges that he purchased a vehicle that came with various engine, transmission and electrical defects.

Tina Williams filed a complaint on April 25 in the Fresno County Superior Court against General Motors LLC and Does 1 through 10 alleging that the automobile supplier and warrantor violated the Song-Beverley Consumer Warranty Act and the Federal Magnuson-Moss Warranty Act.

According to the complaint, the plaintiff alleges that on Sept. 29, 2012, plaintiff purchased a new 2013 Chevrolet Cruze. The suit states that the vehicle delivered to plaintiff had defects, did not conform to the warranty and developed other serious defects including various engine, transmission and electrical defects. 

The plaintiff holds General Motors LLC and Does 1 through 10, inclusive responsible because the defendant allegedly failed to repair the defects and nonconformities and failed to replace the purchased vehicle as agreed under the terms of the sales agreement.

The plaintiff seeks judgment for general, special and actual damages, rescission of the purchase contract, civil penalty, prejudgment interest, attorney's fees, costs of suit and for such other and further relief as the court deems just and proper.
