Couple alleges Nissan Rogue they purchased has defective transmission

SAN FRANCISCO – A Contra Costa County couple alleges the Nissan vehicle they purchased has transmission defects.

Asma Hamdani and Ehsan Hamdani filed a complaint on April 13 in the San Francisco County Superior Court against Nissan North America Inc. and Does 1 through 10 citing the Magnuson-Moss Warranty Act and other counts.

According to the complaint, the plaintiffs allege that they purchased a 2008 Nissan Rogue in February 2008 that developed transmission defects during the warranty period. The plaintiffs hold Nissan North America Inc. and Does 1 through 10 responsible because the defendants allegedly failed to fix or remedy the defects present on the plaintiff's vehicle after several opportunities.

The plaintiffs request a trial by jury and seek actual damages, restitution, civil penalties of two times actual damages, consequential and incidental damages, all legal fees, interest and any other relief as the court deems just. They are represented by Benjeman Beck and Victoria Shin of Strategic Legal Practices, APC in Los Angeles.
