SAN FRANCISCO – A San Francisco solutions provider in plastics alleges it has been damaged by the cancellation of an agreement with Kimberly Clark.
DCO International Trading Inc. and DCO Environmental & Recycling LLC filed a complaint on April 12 in the San Francisco County Superior Court against Kimberly Clark Corp. and Kimberly Clark Global Sales LLC alleging breach of agreement and other counts.
According to the complaint, the plaintiffs entered into an agreement with the defendants in December 2016 for the plaintiffs to purchase secondary plastic materials to repurpose and resell to third parties.
The plaintiffs holds Kimberly Clark Corp. and Kimberly Clark Global Sales LLC responsible because the defendants allegedly canceled the agreement without cause, which the plaintiffs allege has cost them damages of more than $1 million.
The plaintiffs seek compensatory damages in an amount that exceeds $1 million, interest, punitive and exemplary damages, all legal fees and any other relief as the court deems just. They are represented by Bryan L. Hawkins and Bao M. Vu of Stoel Rives LLP in Sacramento.
