Consumer claims Earth Source chocolate bar needs cadmium warning label

SAN FRANCISCO – A consumer claims a chocolate bar manufacturer fails to put warnings of cadmium exposure on its products.

Erika McCartney filed a complaint on April 12 in the San Francisco County Superior Court against Earth Source Inc. and Does 1 through 500 citing health and safety codes.

According to the complaint, the state of California recognizes cadmium as a chemical known to cause birth defects and other reproductive harm. The plaintiff alleges that the defendant's Righteously Raw Pure Dark 83% Cacao Bar exposes consumers to cadmium. The plaintiff holds Earth Source Inc. and Does 1 through 500 responsible because the defendants allegedly failed to use a warning label on its product as required by state law.

The plaintiff seeks civil penalties in the amount of $2,500 per day for each violation, to enjoin the defendant, all legal fees and any other relief as the court deems just. She is represented by Melvin B. Pearlson and Robert B. Hancock of Pacific Justice Center in San Francisco.
