SAN FRANCISCO — A woman is suing Nationstar Mortgage LLC and U.S. Bank National Association, citing alleged breach of contract and negligence for failing to notify her of her eligibility for a loan modification program.
Maria Del Rayo Vazquez filed a complaint on April 12 in the San Francisco County Superior Court against the defendants alleging that they failed to inform the plaintiff that she had been approved for a loan modification program.
According to the complaint, the plaintiff alleges that she suffered damages from not being able to participate in the loan modification program. The plaintiff holds Nationstar and U.S. Bank responsible because the defendants allegedly knew that the plaintiff had applied and was approved for a loan modification program but failed to notify her before the program ended, thus putting her home at risk of foreclosure.
The plaintiff requests a trial by jury and seeks injunction against the defendants, damages, disgorgement, compensatory and statutory damages, punitive damages, all legal fees and any other relief as this court deems just.
