Driver, Evergreen Recycling Express Corp. faces suit over alleged highway damage

SAN FRANCISCO – The state has filed a suit against a San Francisco individual over alleged damages from an auto accident on a state highway.

The people of the state of California, acting by and through the Department of Transportation, filed a complaint on April 11 in the San Francisco County Superior Court against Jiayi Deng, Evergreen Recycling Express Corp., and Does 1 through 20 alleging negligence and other counts.

According to the complaint, the plaintiff alleges that in Dec. 1, 2015, Deng was driving a truck owned by Evergreen westbound on Silver Avenue near Highway 101 in San Francisco and lost control because of inoperative brakes.

The plaintiff holds Deng, Evergreen Recycling Express Corp. and Does 1 through 20 responsible because accident caused the plaintiff to expend money to repair the highway.

The plaintiff seeks compensatory damages, property damage, interest, all legal fees and any other relief as this court deems just. It is represented by Jeanne Scherer, G. Michael Harrington, Karl H. Schmidt and Sammy Obaid.
