Property owners allege construction caused damages, seek $200,000 for repairs

SAN FRANCISCO – The owners of a San Francisco property allege the property was damaged because of nearby construction work.

Juliann and Gerald DeMartini filed a complaint on April 10 in the San Francisco County Superior Court against 1338 Filbert LLC, Achill Beg Construction Inc., Ryan Engineering Inc., Kevin G. O'Connor, K.O'C Engineering and Does 1-20 alleging inadequate repairs.

According to the complaint, the plaintiffs allege that the defendants excavated a 30-foot deep hole in a property adjacent to theirs and that the shoring elements used failed. The suit states in early 2015, the defendants made repairs to the plaintiffs' property, but the repairs were inadequate and damage continues to occur.

The plaintiffs seek damages in the amount of $200,000 and any other relief as the court deems just. They are represented by Joseph D. Ryan and Robert L. Davis of Ryan & Lifter in San Ramon.
