SAN FRANCISCO – A Novato consumer claims that a mortgage company is unlawfully and abusively trying to collect an alleged debt.

Mark Bosia filed a complaint on May 10 in the U.S. District Court for the Northern District of California against Ocwen Mortgage Servicing Inc. and Ocwen Loan Servicing LLC citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he suffered damages from receiving several collection calls from the defendants from September 2010 to June 2016. He claims he has received more than 1,000 calls. The plaintiff holds Ocwen Mortgage Servicing Inc. and Ocwen Loan Servicing LLC responsible because the defendants allegedly used an automatic telephone dialing system to call the plaintiff despite his request to stop calling.

The plaintiff requests a trial by jury and seeks statutory damages; injunctive relief; special, general, compensatory and punitive damages; and any other relief as the court deems just. He is represented by Joshua B. Swigart and Veronica E. McKnight of Hyde & Swigart in San Diego.
