Consumers claim Chevrolet vehicle has defects, seeks replacement

FRESNO – Two Madera consumers claim that a new vehicle they purchased has issues with the radio, oil leaks, acceleration concerns and other problems.

Veronica Fox and Apolinar Fox filed a complaint on May 5 in the Fresno County Superior Court against General Motors LLC and Does 1-20 alleging that they violated the Magnuson-Moss Warranty Act and the Song-Beverly Warranty Act.

According to the complaint, the plaintiffs allege that on March 9, 2013, they purchased a new 2013 Chevrolet Malibu for $28,426.80. Since the purchase, the plaintiffs allege they have experienced nonconformities with the vehicle. 

The plaintiffs hold General Motors LLC and Does 1-20 responsible because the defendants allegedly failed to conform the vehicle to the applicable warranties and failed and refused to make restitution or replacement pursuant to Song-Beverly Warranty Act.

The plaintiffs request a trial by jury and seek replacement or restitution of the subject vehicle, award for damages, attorney’s fees, costs and such other appropriate relief. They are represented by Christopher M. Lovasz and Vanessa M. Lee of Consumer Legal Services PC in Long Beach.
