Fresno County individual claims partner breached contract

FRESNO – A property manager has filed suit against her business partner over allegations of breach of fiduciary duty.

Pholy Tuon filed a complaint on May 8 in the Fresno County Superior Court against Jesse Emmett and Does 1-10 alleging breach of contract and other counts.

According to the complaint, the plaintiff and defendants entered into a partnership to purchase properties in 2009 and that the plaintiff was to pay the property manager. 

The plaintiff holds Jesse Emmett and Does 1-10 responsible because the defendant allegedly demanded that their tenants pay their rent directly to him, ordered them to sign new leases with defendant and now contends that he never entered into a partnership agreement with plaintiff.

The plaintiff requests a trial by jury and seeks damages in an amount not less than $450,000, plus interest, attorneys’ fees and costs and such other just and proper relief. She is represented by Brian N. Folland of The Folland Law Group in Fresno.
