Ally Financial Inc. alleges it is owed more than $16,000 for contract

SAN FRANCISCO – A San Francisco County man is alleged to have breached a retail installment contract.

Ally Financial Inc. filed a complaint on March 27 in the San Francisco County Superior Court Court against Damon Sherwood Spikener and Does 1 through 20 alleging breach of contract.

According to the complaint, the defendant entered into a retail installment contract to purchase a vehicle in 2016, and the dealer assigned the contract to the plaintiff. The plaintiff holds Spikener and Does 1 through 20 responsible because the defendants allegedly failed to pay the plaintiff for the principal amount of the alleged debt.

The plaintiff seeks judgment in the amount of $16,246.45 plus all legal fees and any other relief as the court deems just. It is represented by Adam N. Barasch of Severson & Werson in San Francisco.
