SAN DIEGO – A San Diego consumer has filed a class-action lawsuit against a Van Nuys solar services company alleging invasion of privacy.

Patrick Cross, individually and on behalf of all others similarly situated, filed a complaint on May 24 in the U.S. District Court for the Southern District of California against West Coast Center LLC, doing business as Green World Pro; Yossi Ohayon; and/or Imane Haddada, also known as Imane Bytton, alleging that the defendants violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on May 2, he received a telephone call on his cellular number from the defendants asking if he was interested in a solar system for his home. The defendants allegedly utilized an automatic telephone dialing system (ATDS) or used an artificial prerecorded voice for the calls and invaded the plaintiff's privacy and peace.

The plaintiff alleges the defendants placed telephone calls to plaintiff without prior express consent and called the plaintiff even though his number has been registered on the National Do-Not-Call List.

The plaintiff requests a trial by jury and seeks up to $1,500 in damages for each and every violation, injunctive relief prohibiting such conduct in the future, and any other relief that the court deems just and proper. He is represented by Kevin Lemieux and Josh Swigard of Hyde and Swigart in San Diego and Abbas Kazerounian of Kazerouni Law Group, APC in Costa Mesa.
