Class action filed against Alltran Financial over allegedly unfair debt collection practices

SAN DIEGO – A San Diego County consumer alleges that a debt collector failed to disclose an alleged debt was accruing interest.

Zohal Abdurahman, individually and on behalf of others similarly situated, filed a complaint on May 25 in the U.S. District Court for the Southern District of California against Alltran Financial LP alleging that the defendants violated the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, on Nov. 9, 2016, the plaintiff received the first collection notice from the defendant attempting to collect an alleged debt in the amount of $10,024.42. The plaintiff claims the validation notice did not state that the alleged debt is increasing due to accruing interest, late charges, or other fees. 

The plaintiffs holds Alltran Financial LP responsible because the defendant allegedly failed to clearly state the amount of the debt because it failed to disclose that the debt was subject to daily accruing interest, late charges, or other fees.

The plaintiff requests a trial by jury and seeks to award of statutory damages in the amount of $1,000, award of costs of litigation, attorney's fees, and other relief that the court deems just and proper.
