FRESNO – A Fresno County consumer allege the rear hatch on her Ford vehicle is defective and seeks rescission of the sales contract.
Karen Faulkner filed a complaint on May 22 in the Fresno County Superior Court against Ford Motor Co. alleging violation of the Song-Beverly Consumer Warranty Act.
According to the complaint, the plaintiff alleges that on Jan. 4, plaintiff signed a conditional sales contract to purchase a 2016 Lincoln MKX from one of defendant's franchise dealerships. After purchase, the plaintiff claims the vehicle failed to conform to the terms of the express warranty and implied warranties as agreed in the contract. She alleges the rear hatch fails and will open on its own while she is driving.
The plaintiff holds Ford Motor Co. responsible because the defendant allegedly failed to repair, replace or repurchase the vehicle after its authorized repair facility notified it of the defect.
The plaintiff requests a trial by jury and seeks for rescission of the contract, judgment for actual damages, attorney's fees, costs of suit, prejudgment interest, and for such other relief as the Court deems just and proper.
