LOS ANGELES – A Culver City cosmetic and makeup distributer alleges that its trademark is being used on cosmetics by another company without authorization.
Cosmetic Design Group LLC filed a complaint on June 21 in the U.S. District Court for the Central District of California against Bora Creations S.L., Cosnova Inc., Cosnova GmbH and Does 1-10 alleging trademark counterfeiting and other counts.
According to the complaint, the plaintiff owns the trademark Liquid Metals for eye pencils, eyeliner, eye shadow liquid liner and eye shadow pencils. The plaintiff holds Bora Creataions S.L., Cosnova Inc., Cosnova GmbH and Does 1-10 responsible because the defendants allegedly sells similar products under a similar Liquid Metal mark, which the plaintiff alleges infringes its mark.
The plaintiff requests a trial by jury and seeks enjoin the defendants; order the destruction of all infringing products; accounting of all gains, profits and advantages; profits and damages; all legal fees; treble damages; interest; statutory damages; and any other relief as the court deems just.
