Student alleges Producer's Dairy Foods juice contained cleaning solution, caused injuries

FRESNO – A Fresno middle school student claims that she sustained serious injuries and damages to her stomach and throat because of cleaning solution that was present in juice served at her school.

Xochilt Garcia, by and through her guardian ad litem Hilda Becerra, filed a complaint on June 8 in the Fresno County Superior Court against Producer's Dairy Foods Inc. and Does 1 through 25 alleging strict product liability, negligence and other counts.

According to the complaint, on June 8, 2015, Garcia received an orange juice produced by the defendants as part of her lunch at Sequoia Middle School. The suit states that after drinking it, she immediately felt a burning sensation in her throat and began vomiting uncontrollably. She was taken Valley Children's Hospital for ingestion of the toxic cleaning solution that was contained in the orange juice, the suit states.

The plaintiffs holds the defendants responsible because they allegedly failed its duty to properly supervise, train, and monitor employees in the preparation of the product to ensure compliance with its own specifications and performances standards, as well as to ensure compliance with all applicable health regulations.

The plaintiffs request a trial by jury and seek judgment for general damages, interest according to law, costs of action, and any other and further relief that the court considers proper. They are represented by Alexia Kirkland of Kirkland Law Office of California in Fresno.
