Workers allege company failed to pay proper wages

SAN FRANCISCO — Two employees are suing a Santa Clara County business, alleging unpaid wages and violation of the Fair Labor Standards Act (FLSA).

Jenny Sanchez and Carlos Rivera, also known as Alex Rivera, filed a complaint July 12 in U.S. District Court for the Northern District of California against Dohatsuten Inc. and Seiko H. Alba, and doing business as Dohatsuten, alleging failure to pay fair wages.

According to the complaint, Sanchez and Rivera suffered monetary damages from not being paid all wages due for working more than eight hours a day bussing tables, preparing foods, washing dishes and cooking. The plaintiffs allege the defendants failed to provide adequate rest breaks for the plaintiffs.

The plaintiffs seek trial by jury, compensatory damages, liquidated damages, restitution of unpaid overtime wages, all legal fees, interest of 10 percent on the unpaid overtime compensation, legal fees and all other relief the court deems just. They are represented by attorney James Dal Bon of Law Office of James Dal Bon in San Jose.
