California company accuses tractor business of breach of warranty

FRESNO — A Santa Ana company is suing a tractor distributor, alleging breach of implied warranty, breach of warranty, liability, negligence and negligent misrepresentation.

Movement Management LLC filed a complaint Feb. 22 in Fresno County Superior Court against Branson Machinery, LLC, Mac's Equipment Inc. and Does 1 through 10, alleging they manufactured a defective tractor that was equipped with a defective engine.

According to the complaint, Movement Management suffered damages from purchasing a tractor truck from Bruno Powersports on May 17, 2016, that was equipped with a defective engine which continues to knock and overheat. The plaintiff alleges the defendants failed and refused to fix the defective engine found on Movement Management's tractor truck and instead called the plaintiff a liar and said the plaintiff's misuse cause the problems with the tractor.

Movement Management seeks $30,000, rescission of the purchase contract, general damages, interest, punitive and exemplary damages, legal fees and any other relief the court deems just. They are represented by attorney Rex P. Sofonio of Sofonio & Associates APLC in Santa Ana.
