LOS ANGELES — Trustees are suing a floor covering business, alleging breach of contract.

The Board of Trustees of the Southern California Floor Covering Pension Trust Fund, The Board of Trustees of the Southern California Floor Covering Health and Welfare Trust Fund et al. filed a complaint Sept. 19 in U.S. District Court for the Central District of California against Genesis Floor Covering Inc., alleging the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs have suffered and continue to suffer economic damages as result of Genesis breaching the master labor agreement and trust agreement, including the act of late submission of employer reports and payments. 

The plaintiffs allege Genesis Floor Covering failed to fulfill its obligations under the agreement, failed to pay all current contributions owed in a timely manner, and failed to properly submit reports and payments for employees' work performed.

The plaintiffs seeks trial by jury, judgment for unpaid contributions of $150,519.53, liquidated damages of $291,099.94, prejudgment interest of 7 percent annually, attorney fees, costs of suit and all relief the court deems appropriate. They are represented by attorney Nicholas I. Starkman of Wohlner Kaplon Cutler Halford & Rosenfeld in Encino, California.
