Former employee accuses technology company of wrongful termination

SACRAMENTO — A Stanislaus County man is suing a technology company, alleging disability discrimination, intentional infliction of emotional distress, retaliation and violation of the Family and Medical Leave Act.

Daniel Deigan filed a complaint Sept. 26 in U.S. District Court for the Eastern District of California against HYDAC Technology Corporation and Does 1-100, alleging they violated rights of employees to family and medical leave.

According to the complaint, on June 5, he suffered irreparable injury, emotional distress and monetary damages as a result of defendant’s discriminatory practices of interfering with his right to exercise the protected medical leave under FMLA (Family and Medical Leave Act), to seek treatment for cancer. 

The suit says Deigan, who worked for the defendant as a territory manager maintaining accounts, was further harmed by HYDAC by terminating his employment while he was on an unpaid leave of absence for sickness/disabilities. 

The plaintiff alleges the defendants failed to engage him in a timely and good faith interactive process to seek reasonable accommodations that would allow him to continue working for HYDAC, and caused Deigan physical and emotional injuries including depression, stress and anxiety.

Deigan seeks trial by jury, judgment for liquidated, general, special, compensatory, exemplary and punitive damages, interest, costs of suit, expert witness fees, attorney fees and all further relief the court deems proper.
