Passengers blame driver of another vehicle for causing crash

FRESNO — Two vehicle passengers are suing the driver of another car, alleging he crossed traffic in a careless manner.

Mary Ann Ostergard and Sabrina Ann Montez filed a complaint Aug. 29 in Fresno County Superior Court against the Larence Maxwell, alleging he drove and operated his vehicle so carelessly that he caused a motor vehicle accident.

According to the complaint, on Sept. 7, 2015, Ostergard and Montez were passengers of a motor vehicle traveling eastbound on Merced Street in Fresno when the vehicle was struck at the intersection by the car driven by Maxwell.  As a result, the plaintiffs say they suffered physical injuries and incurred medical expenses. 

The plaintiffs allege Maxwell failed to yield right-of-way to any vehicle when he illegally entered the intersection.

Ostergard and Montez seek trial by jury, compensatory damages of at least $25,000, costs of suit, and all other relief the court rules fair, just and equitable. They are represented by attorney Jeffrey D. Bohn of Accident, Injury and Medical Malpractice Attorneys of California, APC in Fresno.
