Customer alleges Ford Focus transmission is defective

FRESNO — A Kings County man is suing Ford, alleging breach of implied warranty for a Ford Focus vehicle.

Jay Earl Keen of Hanford, California, filed a complaint on Aug. 31, in the Fresno County Superior Court against Ford Motor Company, Selma Auto Mall, Inc., doing business as Selma Mazda, alleging violation of the Song-Beverly Consumer Warranty Act.

According to the complaint, on March 30, 2015, Keen purchased a used 2012 Ford Focus from the defendants over the term of an installment contract for $25,120.40. Despite receiving written warranties and other express and implied warranties, the suit says the vehicle failed to conform to the terms of the contract due to defects and transmission malfunctions. 

The plaintiff alleges the defendants failed to repair, replace or repurchase the Ford Focus after its authorized repair facility notified it of the defect.

Keens seeks trial by jury, replacement or restitution of product, incidental and consequential damages, attorney fees, costs of suit, pre-judgment interest, and all other relief the court deems appropriate.
