Organic food company accused of breach of contract

FRESNO — A crop care retailer is suing a Newport Beach organic food company, alleging it owes more than $55,000 for breach of contract.

GAR Tootelian Inc. filed a complaint Sept. 15 in Fresno County Superior Court against Nino Organics LLC, formerly known as David Nino Organics LLC, David Nino and Victoria Nino, alleging the defendants failed to comply with a contract despite agreeing and receiving services and goods.

According to the complaint, on Feb. 7, 2015, the parties agreed on a contract wherein GAR Tootelian would provide goods and services to the defendants in exchange for a reasonable payment value along with 18 percent per annum on all past due invoices. 

Despite demands, GAR Tootelian alleges it has failed to receive payment in the principal amount of $51,111.15, plus accrued finance charges of $4,036.26. 

GAR Tootelian seeks trial by jury, damages of $51,141.15 plus the finance charges of $4,036.26, with attorney fees, costs of suit and all other fair, just and equitable relief. It is represented by attorney Steven M. Koch of Koch Degn & Gomez, LLP in Visalia, California.
