California couple accused of financial elder abuse

FRESNO — An elderly California woman is suing a Fresno County couple, alleging financial elder abuse.

Fatemeh Sanifar, filed a complaint Oct. 2 in Fresno County Superior Court against Sunnie Maris, Peter Maris and Does 1-15, alleging they breach of good faith and fair dealing.

According to the complaint, on April 4, 2016, Sanifar, 71, entered into a real estate lease with option to purchase agreement with the defendants for property at 5117 N. Van Ness, Fresno. The suit says Sanifar suffered monetary injury from the defendants' malicious intent to offer to sell the property at an extremely overvalued rate of $465,000, instead of its true value of no more than $250,000. 

The plaintiff alleges the defendants took advantage of the vulnerability of Sanifar during a difficult family situation, and continue to seek payment for an agreement that was obtained by fraud and undue influence.

Sanifar seeks trial by jury, compensatory, incidental, consequential and punitive damages, constructive trust and/or equitable lien, attorney fees, costs of suit and all further relief the court deems just. She is represented by attorney Arash Arjang of Yarra Law Group in Fresno.
