Auto financing company alleges California company owes at least $66,000

FRESNO — An automobile financing company is suing a California corporation, alleging it owes more than $66,000 for breach of contracts.

Hitachi Capital America Corp. filed a complaint Oct. 6 in Fresno County Superior Court against Future Fast Inc. and Does 1 through 10, alleging the defendants breached the motor vehicle security agreement by failing to comply with what was stated in the contract.

According to the complaint, on Aug. 15, 2016, Future Fast executed a motor vehicle security agreement for $79,309.00 for value received but Hitachi Capital failed to receive the unpaid balance due, owing and payable immediately. Hitachi Capital also says it is entitled to immediate possession of the collateral as executed in security agreement.

The plaintiff alleges Future Fast failed, refused and neglected to pay the sum or any sum of the balance and failed and refuses to surrender the collateral and still uses it to its own use and benefit.

Hitachi Capital America seeks trial by jury, the principal sum of $66,718.72, plus interest, attorney fees, immediate possession of the collateral, costs of suit and all other relief the court deems just and proper. It is represented by attorney Richard A. Solomon of Solomon, Grindle, Lidstad & Wintringer APC in San Diego.
