Consumers are suing insurance comparison companies for violations of the TCPA

LOS ANGELES — A Studio City woman filed a class action lawsuit against a financial group, alleging violation of telephone harassment statutes.

Lala Sloatman filed a complaint, individually and on behalf of all others similarly situated, Oct. 23 in U.S. District Court for the Central District of California against SmartFinancial Group, United States Insurance and Does 1-10, alleging they violated the Telephone Consumer Protection Act (TCPA) through intrusive and unwanted phone calls.

According to the complaint, Sloatman and other similarly situated consumers have suffered from abuse and harassment, including invasion of their privacy and intrusion on their seclusion, caused by the defendants' barrage of calls by illegally using an auto dialer in an attempt to solicit its services. 

The plaintiff alleges the defendants continued to make calls despite Sloatman's explicit demand to stop the improper calls, and unlawfully utilized an automatic telephone dialing system.

Sloatman seeks trial by jury and, judgment for an award of statutory damages of $500 for each and every violation, and $1,500 for each and every willful violation, injunctive relief, and all other relief the court deems just.
