Fabrics business accuses Burlington Coat Factory of copyright infringement

LOS ANGELES — A Los Angeles fabrics business is suing Burlington Coat Factory, alleging copyright infringement and vicarious and/or contributory infringement.

The Standard Fabrics International Inc. filed a complaint Oct. 23 in U.S. District Court for the Central District of California Western Division against Burlington Coat Factory Investment Holdings Inc., Mystic Weaves USA Inc. and Does 1-25, alleging they violated laws through unauthorized distribution of an intellectual property.

According to the complaint, Standard Fabrics has suffered damages in business and profit as the exclusive owner of unique, two-dimensional, graphic artworks, Design Code “4020” and “7967.” The suit says the defendants unlawfully created, manufactured, imported, distributed, and/or sold fabric and/or garments comprised of fabric featuring a design that is substantially similar to the plaintiff's patented designs. 

The plaintiff alleges the defendants misappropriated, palmed off, and/or infringed on Standard Fabrics' copyrighted designs, and obtained profit at the expense of the plaintiff.

Standard Fabrics International seeks trial by jury, all profits, statutory damages, statutory damages, interest, costs of action, and all further legal and equitable relief the court deems proper.
