FRESNO — An insurance company is suing a Fresno trucking company, alleging it owes more than $78,000 for breach of contract.

Sussex Insurance Company, formerly known as Companion Property and Casualty Insurance Company, filed a complaint Oct. 19 in Fresno County Superior Court against Charles Diaz Trucking Inc. and Does 1-20, alleging breach of good faith and fair dealing.

According to the complaint, on April 21, 2015, Sussex Insurance suffered damages in the amount of $78,881.44 plus prejudgment interest in the amount of 10 percent per annum. The suit says Charles Diaz Trucking breached an agreement by failing to pay a final premium that the the plaintiff issued for a worker's compensation insurance policy. 

The plaintiff alleges the defendants failed to pay all premiums according to the policy/policies when due, and obligated Sussex Insurance to retain and pay for the services of legal counsel to represent and protect its interest.

Sussex Insurance seeks trial by jury, damages for $78,881.44, plus prejudgment interest, costs of suit and all further relief the court deems just. They are represented by attorney Francis T. Sakamaki of Sakamaki Law Firm in Orange.
