Fresno County property owner alleges tenant owes $49,000

FRESNO — A Fresno County property owner is suing a tenant, alleging it owes more than $49,000 for breach of contract.

Baker River Partners LP filed a complaint Oct. 23 in Fresno County Superior Court, against Spectrum Energy Solutions Inc., Michael Jennings and Does 1-25, alleging they breached their duties of good faith and fair dealing.110

According to the complaint, starting Aug. 31, Baker River Partners has suffered damages of $49,283.22, plus interest from the defendants' failure to honor its obligations under the lease agreement for an office at 8050 N. Palm Ave., Suite 106, Fresno.

The plaintiff alleges the defendants failed to fulfill their obligations under the loan contract, received the benefit of the use of property without paying dues, and obligated Baker River to retain and pay for the services of legal counsel.

Baker River Partners seeks trial by jury, damages of not less than $49,283.22, plus interest, costs of suit, attorney fees and all relief the court deems just. They are represented by attorney David M. Gilmore of Gilmore Magness Janisse in Fresno.
