Cyclist blames motorist for injuries

FRESNO — A bicycle rider is suing a motorist, alleging negligence while driving.

Jonpaul Legarreta filed a complaint Oct. 25 in Fresno County Superior Court against Ruben Cota alleging, the defendant drove and operated his vehicle in a careless manner, causing injuries and damages to others.

According to the complaint, on Dec. 1, 2015, Cota was traveling on Eighth Avenue when he he struck Legarreta, who was riding his bicycle. As a result, Legarreta says he sustained physical injuries, lost time from work and incurred costs for medical treatment. 

The plaintiff alleges Cota failed to keep a careful lookout, failed to sound his horn warning of his approach and failed to stop or yield.

Legarreta seeks trial by jury, compensatory damages of more than $25,000, costs of suit and all fair, just and equitable relief. He is represented by attorney Sargis G. Atanous of The Dunnion Law Firm in Monterey.
