Disabled man accuses Sanger mini-mart owner of disability discrimination

SACRAMENTO — A man with a disability is suing a Sanger mini-mart owner, alleging disability discrimination.

Jose Acosta filed a complaint Nov. 16 in U.S. District Court for the Eastern District of California against Balwinder S. Mehat, doing business as U & A Mini Mart No. 2, and Dalbir Singh, alleging they failed to provide full and safe equal access to its facilities in violation of the Americans with Disabilities Act.

According to the complaint, on Oct. 11, Acosta, who requires a wheelchair, was and continues to be deterred from visiting the defendants' facility at 13050 East Kings Canyon Road, Sanger. The suit says Acosta encountered barriers that hinder him from enjoying the goods, services, facilities, privileges, advantages and accommodations offered at the defendants' property. 

The plaintiff alleges the defendants refused to either remove the barriers or seek an unreasonable hardship exemption to excuse non-compliance, refused to adhere to relevant building standards, and failed to modify the facility to remove impediments to wheelchair access.

Acosta seeks trial by jury, injunctive and preventive relief, statutory damages, attorney fees, litigation expenses, costs of suit, interest, and all further relief the court deems proper. He is represented by attorney Zachary M. Best of Mission Law Firm APC in San Jose.
