Disabled woman accuses Fresno restaurant of violating ADA

SACRAMENTO — A disabled woman is suing a Fresno restaurant, alleging failure to uphold Americans with Disabilities Act (ADA) regulations.

Rachel Bryant filed a complaint Nov. 16 in U.S. District Court for the Eastern District of California against Baoying Guan and Yi Lin Hu, doing business as Fresno New China, alleging they denied access to the physically disabled.

According to the complaint, on July 28 Bryant, who requires a wheelchair, went to Fresno New China to have dinner. She says she suffered damages from encountering physical and intangible barriers that interfered with her ability to use and enjoy the goods, services, privileges and accommodations offered at the defendants' restaurant. 

The plaintiff alleges Fresno New China failed to provide tables with enough knee or toe clearances to accommodate a wheelchair, failed to have a safe and clear path to the restroom and refused to adhere to relevant building standards.

Bryant seeks trial by jury, injunctive and preventive relief, statutory minimum damages, attorney fees, litigation expenses, costs of suit, interest and all further relief the court deems proper. She is represented by attorney Zachary M. Best of Mission Law Firm in San Jose.
