Consumer accuses electronics business of false advertising

SAN DIEGO — A San Diego County man has filed a class action lawsuit against a San Jose electronics business, alleging breach of implied warranty, breach of warranty and unfair competition.

Aaron Ramos filed a complaint, individually and on behalf of all others similarly situated, Nov. 15 in U.S. District Court for the Southern District of California against Fry's Electronics Inc and Does 1-10, alleging they breached their duty of good faith and fair dealing.

According to the complaint, Ramos and other consumers similarly situated were caused to suffer damages as a result of Fry Electronics' ' misrepresentation and false advertisement. The suit says the defendants' falsely advertised the warranty that accompanies the purchase of Fry's graphics cards, whereby they promised to replace defective cards. 

The plaintiff alleges the defendants failed to inform consumers that Fry Electronics requires initial registration to be eligible for the warranty, and the defendants benefited and profited from falsely advertising and representing its products.

Ramos seeks trial by jury, an order certifying Ramos as class representative and counsel, corrective advertising, for actual, punitive and statutory damages, attorney fees, costs, interest and all further relief the court deems just.
