Customer alleges auto restoration company owes $40,000 for breach of contract

FRESNO — A San Benito County man is suing a Fresno County auto restoration company, alleging it owes more than $40,000 for breach of contract and unjust enrichment.

Martin Tiscareno filed a complaint Oct. 30 in Fresno County Superior Court against West Coast Chassis LLC, Jeff Hedges and Does 1-25, alleging they breached their duties of good faith and fair dealing.

According to the complaint, on March 22, Tiscareno suffered damages from entering into an agreement with the defendant to purchase a defective 1958 Chevrolet pickup for a total purchase price of $42.000. However, the suit says, the defendants have charged $34,648.56 on the plaintiff's credit card for various parts and services to fix the vehicle without authorization from Tiscareno.

The plaintiff alleges the defendants failed to provide him with a truck in satisfactory condition or refund his deposit of $6,000 and charges to his credit amounting to $34,648.56.

Tiscareno seeks trial by jury, compensatory damages of $40,648.56, plus interest at 10 percent per year from the time of damage, attorney fees, costs of suit and all relief the court deems proper.
