Fresno property owner alleges tenants owe $66,000 for breach of lease agreement

FRESNO — A Fresno property owner is suing tenants, alleging they owe more than $66,000 for breach of a lease agreement.

Pat De Santis filed a complaint Oct. 30 in Fresno County Superior Court against Curtis Esquibel, Marian Esquibel, Wade Metal Products and Does 1-10, alleging they breached its duty of good faith and fair dealing.

According to the complaint, De Santis has suffered monetary damages from the defendants' refusal to pay the full amount of the increased base rent or vacate the premises at 1818 Los Angeles St., Fresno. The suit says the defendants,continue to occupy the Fresno property, including the adjacent vacant lot, despite expiration of the fifth lease extension. 

The plaintiff alleges the defendants failed to reimburse him for their share of the annual property taxes, and failed to pay rent or otherwise vacate the vacant lot that was also owned by the plaintiff.

De Santis seeks trial by jury damages of not less than $66,500, late fees and charges, interest, attorney fees, costs of suit and all further relief the court deems just. He is represented by attorneys Mark E. Chielpegian and Lee S.W. Cobb of Chielpegian Cobb APC in Fresno.
