Insurance carrier alleges Fresno property owners owe $26,000 for crash with cow

FRESNO — An insurance carrier is suing Fresno County property owners, alleging negligence in a vehicle crash with a cow.

IDS Property Casualty Insurance Company filed a complaint Oct. 31 in Fresno County Superior Court, against Agriland Farming Company Inc., Sequoia Holding Inc. and Does 1-100, alleging failure to follow applicable safety guidelines and regulations.

According to the complaint, on Jan. 16,  one of IDS Property Casualty's insured customers was driving near the defendants' property at 6067 N. Sequoia Drive, Fresno. The suit says a cow owned by the defendant ran into the road causing a collision with the plaintiff's insured customer. 

As a result of defendants' negligence, IDS Property was obligated to pay under the insured's policy for the repair of the property and other expenses in the sum of $26,021.98. 

The plaintiff alleges the defendants failed to properly contain the cow that caused the accident, have caused IDS Property plaintiff to expend monies for an insurance claim, and obligated IDS to retain and pay for the services of a legal counsel to represent and protect its interest.

IDS Property Casualty seeks trial by jury, judgment for the principal sum of $26,021.98, costs of suit and all further relief the court deems just. It is represented by attorney Lee M. Mendelson of Mendelson Goldman & Schwarz APC in Sherman Oaks.
