Fresno County property owners allege tenants failed to pay monthly rents

FRESNO — Fresno County property owners are suing tenants, alleging fraud and unjust enrichment.

Michael Pray and Rebecca Pray filed a complaint Oct. 30 in Fresno County Superior Court against Jay Johnson, Barbara Johnson, Central California Electronics Inc. and Does 1-50, alleging they breached the lease contract by defaulting on their obligation to pay rent and property taxes.

According to the complaint, in 2012 the Prays agreed to lease their property at 4254 N. Selland Ave., Fresno, to Central California Electronics with a rent payment of $4,250 per month plus 15 percent to be paid to the Johnsons as co-owners. The suit says Central California defaulted on its obligation to pay rent and entered into a new lease with the Johnsons without the permission or consent of the Prays. 

The plaintiffs allege the defendants entered into a new lease for fraudulent purposes without the actual or apparent authority of the property owners in order to disrupt the unlawful proceedings.

The Prays seek trial by jury, general and special damages, declaratory relief, costs of partition, attorney fees, and all other relief the court deems proper. They are represented by attorney Tyler H. Lester of Gilmore Magness Janisse in Fresno.
