Tenant accuses Fresno apartment operators of breach of contract

FRESNO — A tenant is suing Fresno apartment operators, alleging breach of contract, breach of fiduciary duty and negligence.

Philip Marin filed a complaint Nov. 3 in Fresno County Superior Court against Stoney Brooks Apartments, KRC Management, Veronica Griffit, Judy Lopez and Does 1-20, alleging breach of good faith and fair dealing by terminating his lease.

According to the complaint, Marin, a tenant at Stoney Brooks Apartments in Fresno, has suffered hostile treatment from the defendants. The suit says he was forbidden to house a pet, clean his car and service clients' vehicles, whereas other tenants were allowed to do so. Marin says he was further damaged from the defendants' arbitrary decision to terminate his tenancy June 23 and refused to discuss any remedy. 

The plaintiff alleges the defendants failed to prove he violated the lease agreement by servicing his vehicle and housing a pet dog, caused harm to Marin's customers in that they could not receive immediate service of their vehicles, and caused the plaintiff the loss of profits from customers discouraged by the defendants' actions.

Marin seeks trial by jury, general damages of $10,000, special damages of $5,000, punitive damages of $10,000, costs of action, and all further relief the court deems just. He is representing himself.
