FRESNO — A bank is suing a Fresno County customer, alleging he owes more than $33,000.
Ally Bank filed a complaint Dec. 4 in Fresno County Superior Court against Gabriel Rodriguez and Does 1-20, alleging breach of contract.
According to the complaint, on May 30, 2015, Rodriguez entered into a retail installment sales contract with Ed Dean's Auto Center to purchase a new 2015 Chevrolet Silverado with Ally Bank named as assignor.
The suit says Ally Bank suffered monetary damages because Rodriguez breached the sale contract for the purchase of the vehicle. The lawsuit states Rodriguez subsequently failed to make the required monthly payments, which currently amount to $33,351.69 with finance charges accruing at the rate of 5.49 percent.
The plaintiff alleges the defendants have failed and refused to pay all amounts due Ally Bank or deliver possession of the vehicle.
Ally Bank seeks trial by jury, judgment of $33,351.69, plus accruing charges, attorney fees, court costs and expenses, injunctive relief, turn over vehicle, costs of suit, and all further relief the court deems just.
