Le–Vel Brands LLC alleges Thrive Market is unlawfully using mark

LOS ANGELES – A Texas company that sells dietary and nutritional supplements alleges a Marina Del Rey's products are likely to confuse or mislead consumers because of the use of a similar trademark.

Le–Vel Brands LLC filed a complaint on Dec. 13 in the U.S. District Court for the Central District of California against Thrive Market Inc. alleging trademark infringement.

According to the complaint, the plaintiff sells its products under the Thrive mark and the defendant sells products under the Thrive Market mark. It alleges that it was damaged and injured on its reputation and goodwill as a result of the malicious conduct of the defendant to unlawfully offer and sell dietary and nutritional supplements under plaintiff's Thrive mark.

The plaintiff seeks judgment against defendant, preliminary and permanent injunction, punitive damages, costs, attorneys' fees, and other relief the court may deem just. They are represented by Morgan E. Smith of Finnegan, Henderson, Farabow, Garrett & Dunner LLP in Palo Alto.
