Clovis property buyer alleges granddaughter breached contract

FRESNO — A Fresno County woman is suing Clovis property owners, alleging breach of contract, financial elder abuse, fraud and unjust enrichment.

Shirley Fife filed a complaint Dec. 8 in Fresno County Superior Court against Mark Massetti, Melissa Massetti, and Does 1-20, alleging they reneged on their agreement to sell the Clovis property. 

According to the complaint, in January 2016, Fife agreed to buy the defendants' condominium at 323 N. Grfeco Lane, Clovis, from her granddaughter (Melissa Massetti) and her husband (Mark Massetti). The suit says Fife suffered economic injury by agreeing to assume mortgage payment on defendants' property for an additional amount of $6,000. 

However, the lawsuit states, the Massettis have refused to transfer the title to Fife, unless she pays an additional $32,000, going against the prior agreement. 

The plaintiff alleges the defendants breached the terms of the contract by refusing to sell the property to Fife, received the benefit of Fife's funds in violation of the plaintiff's protected rights as an elderly woman, and deceived Fife into thinking that she actually was buying the property.

Fife seeks trial by jury, compensatory and punitive damages, disgorgement of all monies and things of value, attorney fees, and all further relief the court deems just. She is represented by attorneys Ty Kharazi and Arash Arjang, of Yarra Law Group in Fresno.
