FRESNO — A Tulare County couple is suing General Motors, alleging breach of warranty under the Beverly Consumer Warranty Act and the Magnuson-Moss Warranty Act.
Sylvia M. Uyeg and Brandon M. Uyeg filed a complaint Dec. 11 in Fresno County Superior Court against General Motors LLC and Does 1-10, alleging GM sold the plaintiffs a defective 2014 Chevrolet Silverado.
According to the complaint, on March 26, 2016, the Uyegs purchased the Sivlerado at Martens Chevrolet. The suit says the Uyegs have suffered economic injury from having purchased a defective vehicle from the defendants. The lawsuit states the Silverado has been delivered to the defendants' facility for service and repair on at least five occasions.
The plaintiffs allege the defendants failed to fully repair their Silverado, failed to provide replacement or refund the plaintiffs' money, and impaired the use, value and/or safety of the vehicle.
The Uyegs seeks trial by jury, general, special and actual damages, rescission of the sales contract and restitution of $40,000, incidental and consequential damages of $3,500, civil penalties of $87,000, interest, attorney fees, court costs, expenses and all further relief the court deems just.
