Driver, passenger allege drunk motorist caused crash

FRESNO — A driver and passenger are suing another motorist, alleging the defendant's negligence caused a crash that injured the plaintiffs.

Eberado Garcia and Shirley Lujan filed a complaint Dec. 12 in Fresno County Superior Court against Luis Jonathan Estrada-Raiz, alleging the motorist failed to exercise standard care and skill required in operating a vehicle and was driving while drunk.

According to the complaint, on Dec. 25, 2015, while Garcia and Lujan were driving in Fresno, they were hit by a vehicle driven by the intoxicated defendant. The suit says they suffered damages, including bodily injuries, wage loss and loss of use of property, plus hospital and medical expenses. 

The plaintiffs allege Estrada-Raiz failed to adequately maintain and operate a motor vehicle so as not to cause harm, breached duty of care in operating a vehicle while intoxicated, and failed to be on a proper lookout for other vehicles.

Garcia and Lujan seek trial by jury, compensatory and punitive damages of more than $25,000, costs of suit, and all fair and just relief. They are represented by attorney Jim A. Trevino of Law Office of Jim A. Trevino in Fresno.
