FRESNO — A motorist is suing another driver, alleging negligence caused a crash that injured the plaintiff.
Michael Garcia filed a complaint Dec. 12 in Fresno County Superior Court against Javier F. Chavez and Does 1-25, alleging they failed to exercise standard care and skill required in operating a vehicle.
According to the complaint, on Sept. 1, 2016, when Garcia was driving in Fresno, he was run into by a vehicle driven by Chavez. The suit says Garcia suffered bodily injuries, lost wages, lost the use of property, and incurred medical expenses due to Chavez's carelessness.
The plaintiff alleges the defendants failed to adequately maintain and operate a motor vehicle so as not to cause harm, and breached the duty of care by allowing the motor vehicle for negligent operation.
Garcia seeks trial by jury, costs of suit, compensatory and punitive damages of more than $25,000 and all other fair and just relief. He is represented by attorney Jim A. Trevino of The Law Office of Jim A. Trevino in Fresno.
