FRESNO — A couple is suing a motorist, alleging negligent infliction of emotional distress.
Gilbert Agueros and Desiree Agueros filed a complaint Dec. 18 in Fresno County Superior Court against Gregory Garza and Does 1-50, alleging failure to follow applicable safety guidelines and regulations.
According to the complaint, on Oct. 9, 2017, Gilbert Agueros and Desiree Agueros were driving at the intersection of Clovis Avenue and and Interstate Highway 80 in Fresno when they were run into by a car driven negligently by Garza. The suit says the plaintiffs have suffered and continue to suffer serious emotional distress, humiliation, anguish, and emotional and physical injuries as well as economic losses.
The plaintiffs allege the defendants negligently entrusted, managed, maintained, drove and operated their vehicle in reckless disregard for the safety of other vehicles and motorists on the road.
The Agueroses seek trial by jury, general and compensatory damages, property damages of $20,000, interest, attorney fees, costs of suit and all further relief the court deems just. They are represented by attorney David Yadidi of Yadidi Law Firm PC in Encino.
